Repair Don’t Replace Promotion

This promotion (this “Promotion“) is organised by IB McIntyre & Co, a company registered in the Republic of South Africa with registered office at.8 Loop Street, Maitland, Cape Town, Western Cape, 7405 (the “Organiser”), which is the authorised distributor in the Republic South Africa of WD-40 Company Limited, a company registered in England with company number 01755958, registered office at Brick Close, Kiln Farm, Milton Keynes, Buckinghamshire, MK11 3LJ, telephone number (01908) 555400, and VAT registration number 844274910 (the “Promoter“).

The terms and conditions below set out the terms on which you may participate in the Promotion.  Entry into the Promotion shall constitute acceptance of these terms and conditions. All entry instructions form part of these terms and conditions.

Terms and conditions

1.    This Promotion is open to residents of the Republic of South Africa only, aged 18 or over on the date on which you enter this Promotion, excluding employees and their immediate families and household members of the Promoter and/or Organiser, their agents, and anyone else professionally connected with this Promotion.

2.    The Promotion is free to enter however, to enter the Promotion, you must have an internet connection. The internet connection fee is the responsibility of the entrant.

3.    Entry to the Promotion. All entries must comply with the following requirements

4.    a) entries must be submitted via https://repairchallenge.wd40.co.za/;

b)      entrants must complete in full all aspects of the sign-up form (including their name, surname, address and phone number); and

c)       submit an image or video of your recent DIY project.

5.    Only one entry is permitted per person throughout the Promotional Period. Entries must:

(a) Must be sole and original work of entrant and not copied, in whole or in part, from any other source. Entries by teams and/or groups are strictly prohibited.   Must comply with the technical requirements as indicated on the Promotion Website.

(b)Must not violate the rights of any third party, including rights of copyright, trademark, patent, privacy and/or publicity (e.g. do not include third party logos).  Do not use any music, videos or photos created or performed by any other person. If persons other than entrant appear in entrant’s video and/or someone else recorded the entry video and/or was otherwise involved in the creation and/or development of the entry video, it is the entrant’s sole responsibility to secure the consent and waiver of any rights therein by all such person(s) in writing beforehand. The Promoter reserves the right to condition prize award upon the submission of satisfactory proof of such third-party consent.

(c)Must not be inappropriate, objectionable and/or unfit for publication (e.g., be and/or include pornographic images, nudity, obscenity, violence and/or hate speech).

(d) Must not disparage Promoter, its products and/or otherwise adversely affect the goodwill and business reputation of Sponsor.

(e) Must not advocate alcohol use, drug use, violent behaviour and/or any illegal activity.

(f) Must not display and/or promote products competitive to the WD-40 Company; and must be relevant to the Promotion theme.

 

6.    Each Entrant grants the Promoter and its designees the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sublicensable right and license to use, perform, exhibit, reproduce, edit and/or otherwise exploit Entrant’s Video and/or images in any manner and in any and all distribution channels, venues and/or media now known or hereafter devised, without further notice and/or any compensation of any kind to Entrant.  Entrant further waives any “Moral Rights of Authors” and/or similar natural rights of ownership Entrant may have in Entrant’s Video and/or images.  Entrant further agrees, upon Promoter’s request and without compensation of any kind, to execute any additional documents so as to effect, record or perfect the grant of rights granted to Sponsor herein. 

7.    By participating in the Promotion and without additional consideration and/or consent or prior review and in exchange for the potential to win the Prizes referenced herein, each Entrant (except where prohibited by law) consents to the use by Promoter, Organiser and its designees of his/her first name, last name, hometown, and any other personally identifiable information contained in the entrants video and/or images for the Promotion and/or any advertising and marketing purposes in any media throughout the world. 

8.    Winners. There will be a total of 7 winners for the Promotion: one grand prize winner who will receive the grand prize at the end of the promotion, and six bi-monthly winners who will each receive a prize during the Promotion Period. Winners are selected at random by a 3rd party software from all eligible entries received. The grand prize winner will be selected at random at the end of the Promotional Period, the bi-monthly winners will be selected approximately every two (2) weeks from the start of the Promotion.

9.    This Promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook, Instagram, or Twitter (X). By participating in this Promotion, you hereby release and hold harmless Facebook, Instagram and Twitter from all liability associated with this Promotion. Participants are providing information to the Promoter and not to Facebook, Instagram or Twitter.

10.              All personal data submitted in connection with the Promotion will be processed by the Promoter and Organiser for the purposes of administering and managing the Promotion and the award of prizes (where applicable) and verifying the eligibility of a entrant. By submitting your personal information, you agree to receive emails from the Promoter containing news and offers that we think are of interest to you. You may unsubscribe at any time. Data that is collected from entrants will be used in accordance with the Promoter’s Privacy Policy (available here: http://www.wd40.co.uk/privacy-policy/ and which tells you how we use any personal information we may collect about you by entering this Promotion).

 

11.  PRIZE. There are a total of seven (7) prizes available to be won. These prizes consist of a grand prize: 1 x Master Lock Extra Large Security Digital Combination Safe (LFW123FTC) & 6 x bi-monthly prizes: 1 x Master Lock Select Access Lock Box wall mounted (MA300051) & WD-40 premium (backpack). The approximate retail value of all prizes is R20 000.

12.  The prize is non-exchangeable, non-transferable and cannot be resold, no cash alternatives will be offered. A person cannot win more than one prize.

13.  The Organiser reserve the right to substitute the prize with another prize of equal or higher value if circumstances beyond our control make it necessary to do so.

14.  The decision of the Promoter regarding any aspect of the Promotion is final and binding.

15.  Entry to this promotion opens at 12:01am (RSA time) on 01/11/2024 and closes at 11:59pm (RSA time) on 28/02/2025 (the “Promotional Period “).

16.  Entries received after the end of the Promotional Period (for whatever reason) will be invalid. No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted and no bulk entries.

17.  The Promoter reserves the right at any time, in its absolute discretion, to: (a) verify the eligibility of any participant (including their age and place of residence); (b) disqualify any participant found to be abusing or tampering with the operation of this Promotion or entering using fraudulent means, or who the Promoter believes to have acted in breach of these terms and conditions; (c) disqualify participants who do not give correct contact details or those who make an entry on someone else’s behalf; and (d) disqualify any participant posting an entry or a comment to the Promoter’s Facebook, X and/or Instagram accounts that is, in the Promoter’s opinion, inappropriate, offensive or upsetting to other participants, fans of the Promoter or directly aimed at the Promoter, or contrary to applicable law, and to remove any such entry or comment.

18.  As soon as the prize-winner entry has been validated, the Organiser will commence the prize fulfilment process. The winner will be contacted directly via email after 28th February 2025 (using the details provided at entry) to arrange prize fulfilment. The prize will be delivered within 30 working days from a valid fulfilment of the prize.

19.  The Promoter/Organiser will not be liable if a prize winner cannot take the prize for reasons beyond the Promoter’s control or if the Organiser is unable to contact that prize winner, including due to his or her provision of inaccurate or incomplete information.

20.  If: (a) a prize winner cannot be contacted or does not respond within 28 days of first being notified of their win, (b) the winner is ineligible, (c) the winner’s entry is invalid or disqualified (by means of clauses 16 and 17), or (d) the winner has otherwise failed to comply with these terms and conditions, then such potential winner forfeits all rights to any prize. The Promoter reserves the right to choose and notify a new winner. The Organiser will attempt to contact the winner by email up to two times.

21.  The confirmed prize winner will be announced publicly via Original WD40 SA Facebook and WD40 SA Instagram pages, once the winner has been made aware first.

22.  The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails info@wd40.co.uk If you object to any or all of your name, county and winning entry being published or made available, please contact the Promoter at info@wd40.co.uk (within one month of the end of the Promotional Period). In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

23.  The winner may be required to take part in publicity relating to this Promotion and the Promoter reserves the right to use the winner’s name and image for such purposes. The Promoter does not claim any rights of ownership in your entry.

24.  The Promoter will not be responsible under any circumstances or be liable for any person not being able to enter the Promotion for any reason, including (without limitation) system failures, network error or any other technical malfunction of any kind.

25.  You are responsible for all Internet connection costs charged by your Internet service provider. If you do not pay the bill, please get permission from the person who does.

26.  If the Promoter or Organiser fails to comply with these terms and conditions, the Promoter is responsible for loss or damage you suffer that is a foreseeable result of the Promote or Organiser’s breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of the Promoter’s breach or if they were contemplated by you and the Promoter at the time that you entered this Promotion. The Promoter makes no express or implied warranties with respect to the prizes.

27.  If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions shall not be affected.

28.  The Promoter reserves the right to extend, withdraw, alter or suspend this Promotion or these terms and conditions at any time if circumstances beyond its control make this unavoidable. Any entrant who sought to participate in this Promotion under its original terms will not be disadvantaged by any such change under this clause.

30.  These terms and conditions (including any contractual or non-contractual dispute or claim in relation to them) are governed by the laws of the Republic of South Africa. You can bring legal proceedings in respect of this Promotion and these terms and conditions in the South African courts.
